Generally, in our state there are a number of methods that can be used to delay a trustee sale. These include using the trustee sale verification delay process, filing a civil action to get a restraining order, declaring bankruptcy for the purpose of delaying the sale, or the civil action strategy (where you sue to the bank). In all of these cases, the Trustee is not required to stop the sale unless ordered by the court through a temporary restraining order or preliminary injunction, or they are made personally liable for the action via a Notice of Cease and Desist. Once the sale is final, the person buying the house will be issued the title to the property after payment. Then, it is up to the new “owner” of the home to evict you from the property that will be through an unlawful detainer. Prior to this part taking place, the Trustee will have to file an affidavit and record it with the County or City Recorder that they did everything properly.
